The developer had breached the Private Purchase Contract because of late delivery in handing over the property and lacking the mandatory\u00a0<a href=\"http:\/\/www.marbella-lawyers.com\/articles\/showArticle\/lfo-licence-of-first-occupation\" target=\"_blank\">Licence of First Occupation<\/a>.<\/p>\n<p>Our clients withdrew and litigated for a refund with a favourable outcome. The clients were however countersued by Pe\u00f1arroya for non-completion. This ruling overturns the developer\u2019s lawsuit in favour of our clients and confirms the prior ruling in our client\u2019s favour.
