{"id":78,"date":"2009-11-09T16:22:02","date_gmt":"2009-11-09T15:22:02","guid":{"rendered":"https:\/\/www.lawbird.com\/wordpress\/?p=78"},"modified":"2014-05-05T19:06:22","modified_gmt":"2014-05-05T18:06:22","slug":"another-positive-rulling-at-la-reserva-de-marbella","status":"publish","type":"post","link":"https:\/\/www.lawbird.com\/wordpress\/another-positive-rulling-at-la-reserva-de-marbella\/","title":{"rendered":"Another Positive Ruling at La Reserva de Marbella"},"content":{"rendered":"<p>Following <a title=\"Case won against Pe\u00f1arroya &amp; La Reserva de Marbella\" href=\"https:\/\/www.lawbird.com\/wordpress\/another-case-won-at-la-reserva-de-marbella\/\">the case recently won <\/a>by Lawbird lawyers on behalf of a British client against developer Pe\u00f1arroya, another ruling with positive outcome involving the the same developer has been received in our offices.\u00a0It is a\u00a0second and final ruling at M\u00e1laga\u2019s High Appeal Court, which has been\u00a0passed\u00a0on the 15th October 2009.<\/p>\n<p>Our client had purchased in 2003 an off plan property from developer <strong>Pe\u00f1arroya<\/strong> at well-known development <strong>La Reserva de Marbella<\/strong>, Elviria, Marbella East, M\u00e1laga Province. The developer had breached the Private Purchase Contract because of late delivery in handing over the property and not having attained from Marbella\u2019s Town Hall what is known as a <a title=\"Licence of First Occupation\" href=\"http:\/\/www.marbella-lawyers.com\/articles\/showArticle\/lfo-licence-of-first-occupation\" target=\"_blank\">Licence of First Occupation<\/a>.<\/p>\n<p>Our client withdrew from the Private Purchase Contract and litigated for a full refund of her deposit. She won the First ruling on the 26th February 2008. This First ruling was appealed by the developer\u2019s lawyers. She has now won a Second and Final ruling on her matter which overturns the developer\u2019s appeal. The High Court has confirmed in its entirety the First ruling whereby she was entitled to a full refund of her deposits (over 80,000\u20ac) plus legal interests accrued since early 2005.
